ESIC Ceiling Exceeded: Can She Still Receive Maternity Benefits After Contribution Period?

Dear sir, Due to the annual increment, if an employee exceeds the ESIC ceiling and has contributed up to September, she will receive benefits for the same period. Is she entitled to maternity benefits even after the contribution period?

Hi, If the member is contributing to ESI at the time of proceeding on maternity leave, she will continue to enjoy the benefit irrespective of a hike beyond the ESI ceiling.

Eligibility for Maternity Benefits

All insured female employees who have made contributions towards the ESI fund for a minimum of 70 days are eligible for 100% of their average daily wages for a period of 26 weeks in confinement, 6 weeks in case of a miscarriage, and 12 weeks for commissioning or adoption.

Maternity benefit will not be applicable if the member is out of the ESI limit totally.
