Understanding Weekly Off Rules: Is a Worker Eligible for Sunday Off with a 3-Day Workweek?

Dear Sir, Please let me know if any workman comes to the factory only three days a week or does not come on Saturday and Monday. Will he be eligible for Sunday (weekly off) as per factory rules? Thank you.

Weekly Off and Leave Policy

If the remaining three working days were on leave with pay (any eligible leave), he should get a weekly off day with pay. If you are concerned about sandwiched weekly off (Sunday) with Saturday and Monday as paid privileged/earned leaves, the Sunday shall be marked as an off day as usual because the Factories Act specifically states that any holiday or weekly off coming between two paid annual leaves shall not be counted as leave but should be marked as a weekly off only. Simply put, sandwiching holidays between two annual leaves with pay/earned leave/privilege leave is not allowed.

Casually Employed Daily Rated Workers

Now, in respect of casually employed daily rated workers who are paid for attendance, a holiday of rest is allowed only after six days of continuous work. Additionally, the PL/EL, if availed, shall be considered as days worked for getting a weekly off.
