Contractual Workers and Compliance: Is the Principal Owner Responsible for PF & ESIC?

1. The contractor has 3 employees under him.

2. The principal owner has more than 90 workers directly or indirectly working under him.

Question: Is the principal owner bound to ensure compliance, including PF & ESIC, for the above-mentioned contractual employees?

Yes, if the contractor does not have separate ESI and PF registration, then the principal employer should enroll the workers of the contractor under his registration.
