We are going to engage a new contractor for 30 days of civil work, and they will supply a maximum of 12 workers daily. Can I go for RC inclusion?

Applicability of the Building and Other Construction Workers Act

In respect of workers engaged in civil constructions, the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act 1996 will be applicable. Although constructions for factories are excluded from the purview of the Act, there are differences of opinion among the Law Enforcement Agencies regarding its coverage in areas where the Factories Act is already in force.

However, the Factories Act will apply only to activities connected with the operations of the factory. A license under the Factories Act endorses manufacturing and allied activities, not construction work. Therefore, you may contact the Labour department and seek advice from them.
