How Should HR Handle an Employee Resigning by Paying Their Basic Salary? Seeking Guidance

Dear Seniors,

I am seeking your guidance on the following situation: Procedure for Employee Resignation by Paying Basic Salary

What is the procedure from the HR side when an employee decides to leave the organization by paying the basic salary?

I have received the following email from one of my employees:

"In addition to the training email, as discussed and approved by Mr. X, Sir, I will serve the notice period for 1 month, i.e., up to 15-Sep. For the remaining days of the notice period, I will pay the total amount of basic salary."

Kindly review and let me know if any formalities need to be completed. Apart from the exit formalities, what response should be given to the employee now?

Hi, What was the total notice period, and does your company policy/appointment terms and conditions allow an employee to pay a partial salary in lieu of the notice period? Is it based on the gross salary or basic salary alone?

You may discuss this matter with his superior (X Sir) and come to a conclusion regarding his request for a partial notice period with payment for the remaining days. If approved, you can respond by stating, "Your request to serve the notice period up to 15.9.23 along with payment for the balance days is acceptable to us. Please contact the HR Department for further details and processes."

Notice Period and Payment

The total notice period is 3 months, out of which he will be serving 1.5 months. For the remaining 1.5 months, he will pay the basic salary to the organization. In this case, do I need to take the employee's signature on any letter format stating that he will pay XYZ amount for 1.5 months against his notice period?

Hi, In the resignation letter itself, cover everything. The employee should convey that they are submitting their resignation and are willing to serve a 1.5-month notice period. For the balance of the notice period, they are willing to make a payment in lieu of the notice period. Take a handwritten resignation letter from the employee with a signature.
