Facing Irregular Salary Payments: How Can We Effectively Lodge a Complaint with the Labor Commission?

Dear seniors,

Advice on the Labour Commission Complaint Lodge System

I am a control room senior operator in the West Bengal State Electricity Department (WBSEDCL) substation. I am employed as a contractual employee, but it is actually a permanent job as per recent government regulations. All my colleagues work at this post across the state.

Issue of Irregular Salary Payments

The issue at hand is the irresponsibility of my contractor; our substation employees have experienced irregular salary payments for the past three years. Currently, there is a due salary for the last five months.

We have submitted a letter to our division authority's HR section. The Honorable HR wishes to dismiss the contractor, but due to union pressure, they are unable to do so. In confidence, they have suggested that we file a complaint with the labor commission.

Seeking Advice on Lodging a Complaint

I seek advice on how to proceed with lodging a complaint at the labor commission office. We have all the necessary letters and supporting documents to prove that the contractor is irresponsible and at fault.

Please advise on the correct steps to take in order to address this issue with the contractor effectively.

Filing a Complaint with the Labour Commissioner

There is no specified format for raising a complaint with the local office of the Labour Commissioner, but it is advisable to include a copy to higher-ups, including the Chief Minister. You may do this individually or, preferably, collectively. If there is a union sympathetic to your cause, it would be beneficial for the union to issue the notice on behalf of all of you. After submitting the complaint, ensure you follow up with the local office regarding the action taken.
