Understanding ESIC Wages and Maternity Benefits When Salary Exceeds Limits During Leave

Greetings! Please help me understand ESIC wages and maternity benefits.

Case:

If an employee is on maternity leave and plans to apply for ESIC benefits once she completes the maternity leave to receive ESIC wages. However, during her leave period, her salary increased, and the ESIC limit exceeded the gross salary of Rs. 21,000.

Maternity leave: 1st June 23 to 31st Dec 23. ESIC contribution will be paid until 30th Sept 23.

Is the employee eligible to receive wages from ESIC for the period of 1st Oct 23 to 31st Dec 23, or does it have to be paid by the employer? Please confirm.

She will receive the benefits because her maternity benefit from the ESIC will be applicable, as her benefit period corresponding to her contribution period of April 23 to September 23 will extend until next June.
