Understanding Casual Leave Under Maharashtra S&E Act: Annual or Monthly Credit?

Can anyone please help me with the casual leave provisions applicable to any establishment as per the Maharashtra Shops and Establishment Act?

Leave Credit Frequency

1) Is it good to follow leave credit on an annual/monthly basis?

Leave Crediting for New Employees

2) If an employee onboards post the 2nd week of any month, is leave crediting necessary for that month?

In Maharashtra, employees in shops and commercial establishments are required to receive 8 casual leaves every year, credited on a quarterly basis. The Act does not specify advance credit of leave. However, in the absence of any explicit direction, it is presumed that casual leaves shall be credited at the beginning of each quarter. As one quarter corresponds to two days' leave, decisions on granting leaves proportionately can be made. To standardize the leave crediting process, it is recommended to consider the first of January, April, July, and October as the cutoff dates.

Yes, as said by Madhu, the Act is silent on advances.

Leave Provisions under the Maharashtra Shops and Establishment Act

As per the Maharashtra S&E Act, 8 leaves are considered as CL cum SL. It is better to consider them pro rata for the whole year.
