Actions for Not Serving Notice Period

In such a situation where an employee fails to serve their notice period, disciplinary actions may be taken according to the company's policies and procedures. These actions could include financial penalties, withholding of benefits or salary, or even legal consequences depending on the severity of the breach. It is essential for organizations to have clear policies in place regarding notice periods and the repercussions for non-compliance to maintain order and discipline within the workforce. Regular communication and enforcement of these policies can help prevent such issues from arising and ensure smooth transitions when employees decide to leave the organization.

Hi, If the employee serves the proper notice period as per the appointment terms, he/she can be relieved properly. However, if the employee partially serves notice at the discretion of the employer, the balance notice period days can be recovered from the employee's salary. If the employee does not agree to the proper notice and also does not accept to make payment in lieu of the notice period, then it will result in termination of employment, and he/she will not be eligible for proper relieving.

Management can initiate action based on the terms and conditions mentioned in the appointment letter (separation clause) of the concerned employee. You can adjust the notice period salary from his F&F settlement or ask him to deposit the same before issuing the relieving order and releasing his F&F dues.

However, depending on the candidate (his behavior at work, punctuality and attendance, job performance, his way of interaction with his superiors, peers, and subordinates, his length of service in the company, and his future career prospects), management can exercise discretionary powers.
