Case Study: Does Sandwich Leave Apply When Taking a Day Off After a Weekend?

Shweta Sawale
Dear Seniors,

Please guide me to solve the following situation:

Case Study:

If an employee is taking leave on the 17th of July 2023, in continuity with the weekly off (15th, 16th July), but will be present on Friday, which is the 14th of July. Does the sandwich leave apply here?

Request you to guide on this.

Hi, If Saturday is a working day for you, then a leave of absence for the period from July 15th to July 17th needs to be considered as a 3-day leave. This means the sandwich leave policy will apply.

If Saturday is a holiday for your office, then only July 17th, 2023, will be considered as leave, as July 15th and 16th, 2023, are days off. This means the sandwich leave policy will not apply.

Hi, In general, casual leaves can be availed for a minimum of half a day to a maximum of three days. Beyond this, leaves should be availed as earned leave or privileged leaves.

Rather than a monthly limit based on the genuineness of the leave requirement, employers used to consider the leave requests of employees. If an employee requests 15 days of leave for their marriage, subject to the leave balance, the employer needs to consider this and cannot apply the monthly limit rule here.
