Background Check Confusion: Can My Employer Say I Was Terminated Despite My Relieving Letter?

Hello, I just want to ask... I have been relieved and have a relieving letter stating that they are accepting my resignation. But in the background verification, they said I was terminated. Can they do that?

Hi, When you receive a relieving letter after resignation, it is considered proper relieving. However, during the background verification process (BGV), there is a possibility of the employer including negative comments such as being ineligible for rehire, having attitude issues, or being a troublemaker. These outcomes cannot be predicted at this point.

By the way, when you ask a question, provide a detailed background of your resignation (similar to what you shared with me in a private message) to receive an accurate response. Otherwise, the response may not be precise.

I recall that you may have utilized some pressure tactics through the labor office when you were relieved, as mentioned in a message I read some time ago. Given this context, it is uncertain how the employer will react during the BGV.

Be optimistic and try not to overthink the situation, as there are aspects beyond your control.

You have been relieved and received a relieving letter. It states that you have been relieved from the services gracefully.

Improper BGV Remarks

The BGV remarks of termination by your employer are improper and illegal, falling under unfair labor practice.

Legal Action

You have one option available to you, which is to lodge a defamation case worth crores in court against the CEO/MD. When seeking suggestions on such a sensitive matter, it is advisable to attach the letter while hiding your name and company for better advice.
