What to do if there is no charge sheet issued

What should be done if there is no charge sheet issued and the suspension period is extended for more than one year? Please guide.

I am working as an employee in the manufacturing industry in a private company.

Suspension and Inquiry

One day, our manager and HR called me and directly gave me a suspension/pending inquiry letter. The reason for the suspension is my involvement in delaying work performance and going slow.

At the time of issuing the suspension letter, I requested my HR and manager to give me a chance to prove that I did not engage in the behavior mentioned before the suspension. However, my request was not accepted by the manager and HR.

As of now, no charge sheet has been issued, and no inquiry has been conducted. I have been receiving the subsistence allowance every month as it is 90%.

Dear Anonymous,

Issuing a charge sheet and conducting a domestic enquiry are responsibilities of the management, not the employee. Since you are receiving 90% of your wages, you should simply enjoy them.

Upon receiving any communication from the management regarding further proceedings, it would be advisable to consult a lawyer and seek their advice before responding to the management.
