Can the company establish its own rules for earned leave? The company states that if you have not completed four years of service, we will not pay out your earned leave in full during the final settlement.

There can be leave rules for the establishment, but the rules should not be less favorable to the employees than what is available in the Act, i.e., Factories Act, Mines Act, Plantation Labour Act, Shops and Commercial Establishments Act, as the case may be.

Nowhere is it said that there should be a waiting period of four years to encash leave, but the unavailed earned leaves shall be encashed at the time of full and final settlement without reference to the length of service.
