What is the salary that you have paid for 10 days (if the employee has joined on 21st May, naturally he will be paid only for 10 days) that will qualify for ESI?
Components considered for ESI
For ESI, all components except the washing allowance (provided the employee is given a uniform) and conveyance allowance are considered.
Deduct and contribute ESI on the gross. If the said amount, i.e., 4304, is before deducting ESI, then deduct 0.75% of it as the employee's share and contribute 3.25% of it as the employer's contribution.
(Is Rs 12433 not your gross/ESI qualifying salary? Then how does it come to 4304 for 9 days?)
21.5.23 is a Sunday. Did the employee join on Sunday? I hope the Date of Joining (DOJ) should be 22.5.23.
Salary Calculation for May 2023
After 21.5.23, there is only one Sunday, which is 28.5.23. As the salary is inclusive of Sunday as well, you should consider the total earned gross salary for the month of May 23 right from the DOJ of the employee.
ESI Calculation Basis
Why are you sticking to the basic salary? ESI should be calculated on the earned gross salary and not on the basic salary.
What is the relevance of deducting ESI on minimum wages payable?
If the given amount, i.e., 12433, is the minimum wage, it should be for one month. For an employee who joined on 21st May, only a proportionate amount needs to be paid.
