Workers' Compensation vs. ESIC: Can an Employee Be Covered by Both?

Is the employee eligible for Workers' Compensation (WC) policy even if he is already covered under ESIC? Please suggest.

Hi, if an employee is covered under ESI, there is no need for WC coverage.

Any employee covered under ESIC won't receive benefits under the Workmen's Compensation Act. There are many court rulings stating that no two or more benefits are provided for the same injuries.

It should be viewed that all employees who meet with an accident during the course of employment are entitled to compensation following the provisions of the Employees' Compensation Act. However, in respect of an employee covered by the ESI Act, the compensation payable under the aforementioned Act will be paid by the ESI Corporation only.
