Leave is a legal entitlement of an employee and an indivisible part of the total employment package. All employees have a right to avail leaves and to be absent from work on personal grounds/sickness etc. All the same what is important is employees should adhere to the Company's leave policy and avail leaves well within the limit and plan for planned leaves to a maximum possible level.
While unplanned leaves on sickness ground is inevitable habitual unplanned leaves should not be tolerated and employer should deal it with disciplinary action if unplanned leaves availed even after counseling.
