Relocation expenses and mental harassment compunction

I got offer letter on mail after telephonic interview from HR (sociapa noida 116), and I confirmed job joining that and I came from Varanasi booked hostel and joined company from 2nd May.May 2 After working the whole day and completing the joning formalities, the CEO of the company said to HR that she doesn't like the candidate (it's me).While she did not discuss any job with me nor did any official meeting.I have to complaint against this company and whatever expenses happened during my relocated and I want compensation against mental harassment and my 1 day salary.plz help what I can do , and i have to mail them regarding this compensation and expense

Hi,

Hiring and firing in one day is definitely not ethical especially that even a outstation candidate who had relocated to the work location purely based on the offer issued.

On the day of joining have they issued you any Appointment letter ? If so please check the separation clause in the Appointment Order. Though it might be Employer's choice whether to keep a Employee or not they are supposed to compensate you properly as per separation clause.

You can write a detailed email to the CEO about the expenses incurred by you purely based on the employment and asking the company to refund the same. You can send the same through Register post with Acknowledgement due as well. In case of no response you may contact the Labour Officer of that jurisdiction.

You may serve them a legal notice also if need be if no response.

thx for the prompt response.

I got only OL (Please find attachment for reference), HR prepared AL but did not share with me. I want to mail them in legal language, so that they don't do this to any other employee in future. And how can I process the legal notice, I have no idea about it.

This is just a email offer. So Appointment Letter not issued. Do you have any other proof related to one day joining over there? Also they hired you as Manager HR. So by approaching Labour Office you might not get significant response. So I suggest you just send a letter to them through RPAD asking for refund of expenses incurred.

Present the fact that you travelled to Noida from Varanasi purely based on the offer email and also incurred money towards hostel booking whereas you were not allowed to continue without any reason or justification.

Present that you were humiliated by their Act of not allowing you to continue and was subjected to mental agony for no fault from your end.

Ask them to compensate lumpsum compensation amount of Rs.____. Tell them that if they fail to settle on or before____you will be constrained to approach Civil Court for justice.

Mark copy of the letter Labour Commissioner/ Joint Commissioner of Labour of respective juridiction.

Given the designation of the employment offered, the remedy needs to a civil action than approaching Labour Department. You can serve a notice, preferably through an Advocate, before approaching the Civil Court. There is also the option in approaching the Adalat functioning under the District/Taluka Legal Service Authority.

I cannot thank you enough for your valuable suggestions and mental support.
I did as you suggested, and they offered me back to join that company and the communication process is on for compensation.
But I am not going to join that company, I am looking for another opportunity.

It is a good decision not to join them again as such Employers will go to any extend in future as well.

Please stick on to your reimbursement claim on actual expenses incurred.

His reply as following :-

Hi Archana,
We have to start fresh and accordingly things will be decided.
Kindly acknowledge the same if you want to join and continue further.
Things will be happen on mutual understanding.
