Small Business Dilemma: Can We Use Model Standing Orders Without Certified Ones?

Kenneth Dias
In the absence of standing orders for an organization employing fewer than one hundred employees, can the model standing orders be followed in addition to the organization's rules and regulations? Thank you.

Yes, immediately upon the application of the Standing Orders Act to your establishment, the model standing order will have to be adopted. Within a period of six months, you can draft and get your own standing orders certified. Although the principal Act has a provision for the application of the Act for establishments employing 100 or more, the state amendments may vary, and in many states, it is 50 and not 100.

Thanks for giving clarity about standing orders. I recently heard that it is applicable to offices situated in Haryana. I'm curious to know how many of the big firms have certified it as of now since this was implemented in December 2018. What are the implications if any corporation is not complying with the same?
