IF HE GOES FOR LEAVE OR ABSENTEESAM HIS WAGES FALLS BELOW 21000

IN THIS CASE WHETHER HE IS ELIBIBLE FOR ESI COVERAGE OR NOT

I HAD DISCUSSED THE MATTER WITH MANY OFFICIALS ALL ARE HAVING DIFFERENT OPINION

ESI coverage is decided by notional wages principle whereby if the (notional) wages exceeds Rs 21000 had an employee worked for the entire days in the month, say, 26 days or 30 days as the case may be, he will be excluded from ESI coverage. In the next month, if his salary drops down to less than Rs 21000, the number of days present would also come down and as such there is no need to cover him because his notional wages is still above Rs 21000.

Please note that if the employee is receipt of any conveyance allowance, that allowance may be deducted from the gross salary to decide his eligibility for coverage under ESI.

All the benefits as per Maternity Benefits Act like 26 weeks paid leave, pre natal and post natal care or medical bonus of Rs 3500 are available to employees covered by ESI. The salary during the maternity leave days will be paid directly to the employee by the ESI Corporation.
