HR related compliance in a startup manufacturing company

Dear Experts.

I have started my new job as a HR in a 6months old startup company dealing in manufacturing and assembly of battery packs for EV. To start with please help me with how to conduct a compliance audit at the facility to ensure they are compliant or not as per the factories act to start the production activities.

How many employees are there? It is depending on the number of employees that many of the labour laws become applicable. Then Bonus Act will be applicable from the year in which you make profit or after five years. For doing audit please get the online form available or follow the link.

The total number of employees are 300 on roll and 500 on contract. Kindly let me know what kind of audit can be done as per the statutory compliance in line with factories act. And does EV battery packs assembly will be factories act or shops and establishments act.

The number of employees is not that important as far as an audit is concerned. But you can include the facilities like ambulance room, facilities for for first aid, doctor on call, welfare welfare officer, canteen etc also under the audit.

Electronic Vehicle (EV?) battery assembly will come under Factories Act only because there is some manufacturing taken place or conversion of something into a usable product. Therefore, it will come under Factories Act only. You may also go through the attached forms and registers and do it according to your state Rules. The one attached is prepared with reference to Kerala Factories Rules and hence the form numbers may change. This is only for a guidance.
