Dear Experts, I have started my new job as an HR in a 6-month-old startup company dealing in the manufacturing and assembly of battery packs for EVs. Please help me with how to conduct a compliance audit at the facility to ensure they are compliant with the Factories Act before commencing production activities.

The total number of employees is 300 on the roll and 500 on contract. Kindly let me know what kind of audit can be done as per the statutory compliance in line with the Factories Act. Also, does the assembly of EV battery packs fall under the Factories Act or the Shops and Establishments Act?

The number of employees is not that important as far as an audit is concerned. However, you can include facilities such as an ambulance room, first aid facilities, doctor on call, welfare officer, canteen, etc., under the audit.

Electronic Vehicle (EV) battery assembly will come under the Factories Act.
This is because there is some manufacturing taking place or conversion of something into a usable product. Therefore, it will fall under the Factories Act. You may also review the attached forms and registers and fill them out according to your state rules. The attached document is prepared with reference to the Kerala Factories Rules, so the form numbers may vary. This is provided solely as guidance.
