All persons engaged or employed in an organization are eligible to receive compensation under the Employees' Compensation Act. In respect of an employee, including a trainee who is covered under the ESI Act, the compensation admissible under the Employees' Compensation Act will be managed by the ESI Corporation. Coverage Under the Employees' Compensation Act For coverage under the Employees' Compensation Act, the system of reward has no relevance. In the absence of any evidence to show the actual remuneration for service, the appropriate authority will take Rs 15,000, the maximum salary as per the Act, as the base for deciding the amount of compensation.
