Worried About Gratuity and Incentives if My Company Goes Bankrupt – What Can I Do?

I was working in a partnership firm as an Accounts Officer since 1979. The firm grew day by day, and many units/companies, both Pvt and Ltd, were also established. Therefore, I also oversaw the work of all companies, although my name was registered in the partnership firm. I managed HR, Accounts, Income Tax, Sales Tax, Financial Institutions, and all other departments as a Senior. The units were located in Punjab, Chandigarh, Haryana, Himachal, Assam, Delhi, etc.

After the dissolution of the family of directors, they lost interest in running the current business, and it became non-performing assets (NPA) in the bank. As a Senior, I am still with them due to my experience and relationships in all departments. However, they now conceal everything from the staff and show no interest in the business. They are preoccupied with other businesses they started after diverting funds from this group of industries. On 1/04/99, they transferred my name from the partnership firm to a Limited company.

Now, my concern is if they do not pay my gratuity and other incentives if they go bankrupt, how can I retrieve my money from them?

Hi, For gratuity purposes, your actual date of joining (DOJ) should be considered. Please retain copies of all relevant documents such as the appointment order, transfer order, or any other internal documents issued by your employer that will confirm your employment and continuity with them.
