If an employee is deceased after one day of duty, are they eligible for EDLI benefits and workers' compensation policy? If yes, what is the calculation process?

Eligibility for EDLI and Workers' Compensation Policy

EDLI applies to all employees who contribute to PF. Though there is no minimum service requirement for receiving the amount prescribed under EDLI, the employee should be an active member. If the death occurs on the same day or within two days of joining EPF, it raises a legal question. Conversely, if the employee was already a PF member in a previous organization, they should have a contribution history for their dependents to receive EDLI benefits. However, if the employee is new and has not contributed to PF at all, the question of applicability arises.

EDLI Benefits Calculation

EDLI is an insurance linked to deposits (in PF), and the amount is calculated based on the PF accumulations of the last year, with a maximum admissible amount of Rs 7 lakhs.

Workmen Compensation Policy

Regarding the WC Policy, I assume you are referring to the Workmen Compensation Policy. Workmen (Employees) Compensation only applies if the employee dies due to an accident or employment injury during employment. The policy does not cover deaths due to natural causes.
