If a contractor gives work to a sub-contractor and a worker of the sub-contractor has worked for more than 5 years, is he eligible to receive gratuity from that sub-contractor?
If that subcontractor is an establishment covered by the Payment of Gratuity Act, he can claim gratuity from him, i.e., his employer.
