Regarding higher pension as per the recent Hon'ble Supreme Court decision, I request you to please give suggestions for proceeding.

1. I contributed to PF from 01-10-1989.
2. My plant was closed in April 2014, and I paid PF contributions up to 30-09-2013.
3. PF authorities gave the date of exit as 30-09-2013.
4. Superannuation date is 30-09-2013.
5. My date of birth is 21-01-1958, and I completed 58 years on 21-01-2016.
6. Pension commenced at Rs. 6500/- from 21-01-2016, and I have been receiving Rs. 2275/- since then.
7. I have not given the option to the PF to deduct from the total basic and DA.
8. The employer deducted Provident fund on the total basic and DA, and pension contributions were deducted on Rs. 6500/- only.
9. Please advise me on how to proceed further in this regard to get a higher pension.

Since you exited from PF membership on 30.09.2013 and there is no mention of a joint declaration by you under the former Para 11(3) and Para 11(4) available either with you or your employer, it is presumed that either you or your employer is holding such a valid joint declaration. In that case, EPFO has allowed application for higher pension before 3rd March 2023, only through the online link provided in their member portal, which has now been removed by EPFO. As of now, there is no possibility for you to claim a higher pension, in my view.

Probably not really, the first application is still valid, all the more so that the right to the allowance has already been granted!
