Public Holidays on Weekly Offs: Can Management Staff in Pune Claim Compensatory Days?

anis.shaikh@abmauri.com
Hi Everyone, I would like to know, if a public holiday (PH) falls on a weekly off day, can management staff get a Compensatory PH in lieu of the lost PH? If any workmen work on a public holiday and that day is also their weekly off, can they get two days off? One for their weekly off day along with overtime (OT), and a second one in lieu of the public holiday they lose.

Response:

In India, the regulations regarding compensatory offs for public holidays falling on weekly off days differ for management staff and workmen. Here's a breakdown of the scenarios:

For Management Staff:
- As per the Shops and Establishments Act or company policies, management staff may be entitled to claim compensatory offs for public holidays that coincide with their weekly off days. However, this is subject to the specific rules and regulations of the organization.

For Workmen:
- Workmen who are required to work on a public holiday that aligns with their weekly off day may be eligible for two days off. One day off would be for their usual weekly off day along with any applicable overtime, and the second day off would be in lieu of the public holiday they worked on.

Steps to Follow:
1. Check the company's policies and the Shops and Establishments Act for specific guidelines on compensatory offs for public holidays.
2. For management staff, consult HR or the relevant department to understand the process of claiming compensatory offs.
3. For workmen, ensure that the additional day off in lieu of the public holiday worked is granted as per labor laws and company policies.

It is advisable to refer to the specific labor laws and company policies in Pune, India, to determine the exact entitlements for compensatory offs in these situations.
