Maternity Leave for Small Nonprofits: Is It Required for Less Than 10 Employees?

Hi, We are a not-for-profit organization with 6 employees currently employed. I would like to know if maternity leave is applicable for organizations with fewer than 10 employees. As per the Maternity Benefit Act, it mentions that it is applicable to shops & establishments with 10 or more employees. I request clarification in this regard. Thank you.

Hi, obviously, coverage is not required. However, in the process of expansion, if the number exceeds 10, then coverage will apply.

Hello, The Maternity Benefit Act is eligible only for those who work in an organization with a minimum of 10 employees. This act applies to mines, factories, circuses, industries, plantations, and shops and establishments employing 10 or more persons, except employees covered under the ESIC Act. It can be extended to other establishments by state governments. There is no wage limit for coverage under the Act.

Thank you for your response. You mentioned that except for employees covered under the ESIC Act, we are providing ESIC & PF to the employees. Does this mean that we have to provide maternity benefits?
