Absconding Employees: Are Employers in Karnataka Liable for Unclaimed Wages?

Some of the employees have left the job without serving the notice period (absconding). Is the employer liable to pay unclaimed wages for such employees in Form B to the Welfare Commissioner of Karnataka?

Normally, the fines collected from the workers are to be deposited in the Welfare Fund. At the same time, there is nothing wrong if you keep it separately for use in your organization for purposes exclusively related to the welfare of the workers.

Unpaid wages
Unpaid wages, per se, is an amount that is payable to the employee concerned when he demands it. The constitutional validity of this provision in the Welfare Fund Acts was discussed by the Honorable Supreme Court of India in Bombay Dyeing & Manufacturing vs The State Of Bombay And Others (1958 AIR 328). It was observed that unpaid wages are unquestionably monies which belonged to the employer.
