How Can We Legally Recover a Company Laptop from an Ex-Employee?

shyam-lekule
One of the employees (female) from my company resigned without serving a 2-month notice period and still has not submitted the company laptop 5 months after resignation. We have sent emails and notices from the HR Department and one legal notice from the Legal Department for the same. As per our employment letter, every employee should not carry any company device or equipment (such as a laptop, etc.) after resignation.

Kindly suggest legal action to recover the company laptop from the employee, which contains our confidential information.

Hi, As per general employment terms, all company assets should be returned to the company once the employee is no longer continuing with the company. I hope you have documentary proof regarding the issue of the laptop assigned to the absconded employee. Please send a final letter to the absconded employee via Registered Post Acknowledgement Due (RPAD), stating that the company will lodge a police complaint if she fails to return the laptop to the company on or before [date].

Legal Department Involvement
Since we have a Legal Department, they are better equipped to handle the next steps in this case. Please discuss this matter with them.
