Struggling to Get My Husband's Final Pay and Gratuity After Resignation – What Can We Do?

jignya-shedge
Sir, My husband resigned from a public limited company on 31 March. His resignation was accepted on the same day. However, since then, his full and final settlement has not been processed. His last salary has not been received, and his gratuity has not been cleared, despite his 6 years of service with the company. He has been actively following up via email, phone calls, and in-person visits, but the responsibility keeps getting shifted from one senior management person to another. He has made multiple visits to the office to request the pending dues. Please guide us on how we can proceed to obtain the outstanding salary and gratuity.

Thanks and Regards.

Hi, He can represent himself before the Assistant Commissioner of Labour in the relevant jurisdiction and request their intervention. For the full and final settlement, he should approach the Labour Inspector.

Hello, An employee is eligible for gratuity benefits after completing 5 years of continuous service with one employer. Since the employee has completed 6 years of continuous service, he is eligible to receive Gratuity Benefits. As V.M. Lakshminarayanan Sir has clearly outlined both points, you can follow the same.
