How Do I Correct My Tax Records After Leaving a Job Without Notice?

I need help. I joined a company on 30 May 2022 virtually and left on 3 June 2022 after informing the manager on a call and explaining why I could not continue. He understood my situation. I never went to the office and did not receive any ID card, laptop, or other assets.

I never shared any signed appointment letter or any signed document with the employer. My salary account was not opened. During the offer release, I shared payslips, UAN number, PAN card, Aadhar details, and accepted the offer via email. I left the company due to personal reasons and the conditions mentioned in the appointment letter. I received the appointment letter on my personal email on 3 July after I emailed HR and the manager.

During this period, I communicated 1-2 times with my manager from my personal email about not being able to come to the office due to personal reasons.

I joined another company on 6 June and hid these details from my current employer.

On 7 June, I received a call from HR to send an email about my resignation.

On the same day, I informed HR and the manager by sending an email from my personal email. After sending the email, I got a call from HR and explained the situation, which she understood.

A few days later, I received a call about exit formalities. I explained that I was not seeking any salary or benefits. She mentioned that the backend team might mark me as absconded, but I heard nothing further.

Later, I observed that the employer created the EPF and transferred amounts for 2 days in May and 7 days in June, with no further transactions. A few months later, I noticed in the 26AS form that they mentioned paying me a salary for May and June, but I did not receive any salary. The amount for May seemed more than a month's salary if divided by 12, and June also showed a higher amount. However, I did not receive any salary.

Please help me handle the ITR properly. I have not contacted the company since. Should I reconnect with the employer to correct the information, as I did not receive any salary, and they mentioned an excess amount (about 5-6 times the salary details in the offer letter) in 26AS, which was supposed to be paid as per the offer letter for the days I was there?

Please guide me on this.

Hello, In reference to the above, as you have mentioned clearly that your PF contribution has been received, but the related month's salary has not yet been received and you are looking to get it. However, remember that you have not served any notice period, and your clearance process is also not yet completed/still pending. Once you communicate with the HR/Employer, they will ask you to complete your clearance process. After that, they will deduct the notice period amount from your salary. If the amount exceeds, they will send a recovery letter to deposit the recoverable amount for further processing.

Furthermore, it is the responsibility of the employer to deposit the amount deducted towards Employees' Provident Fund in the employee's PF account every month. According to the existing Employees' Provident Fund Organisation (EPFO) rules, PF is another part. Employers cannot recover any recovery amount from PF.

2) 100,000.00 Rs. joining bonus would be paid after 60 days of joining. It was discussed with HR during the offer processing. In the offer letter, they mentioned the joining bonus, but no terms and conditions are specified about the bonus.

I was there for 9 days, including Saturday and Sunday. For 9 days, the total amount would be around (1,000,000 * 9) / 365 = 24,657 Rs. But on the income tax website, it shows that they paid around 125,000 Rs. for 9 days. How can this be possible? Are they showing that they paid me the bonus as well?

I am worried about ITR filing.

Since the previous employer has shown the salary as paid to you in Form 26AS, the IT department will consider it as salary paid to you. This amount will be added to your earnings, and accordingly, income tax is payable by you for this year. It may seem like the employer's way of getting back at you. Unless the employer revises the Form 26AS data, there is no escaping this liability.
