If a company has branches in two states, what will be the minimum leave it can provide according to Shops and Establishment Acts?

If a company has branches in both Noida as well as Punjab, then what should be the minimum casual leave for the employees? According to Punjab Shops and Establishment Act, the minimum is 7 days whereas according to the UP Act, it is 10. Can the Company go according to the Punjab Act and provide casual leave for 7 days in Noida after writing to the Labour Commission?

The proposal to allow Casual Leave to NOIDA based employees on the basis of Punjab S & E Act is per se illegal and improper. The NOIDA based employees are entitled for 10 days CL as per the UP S&E Act and any reduction thereon is not countenanced.

Whenever an establishment falling under the Shops and Establishments Act having branches in more than one State and there is inter-state transfer of the services of the employees, the employment benefits would be applicable to the employees only as per the standards prescribed under the State Shops and Establishments Act where the branch is situated. In order to tide over this difficulty as well as uniformity in service conditions, it would be better to devise the leave policy on the basis of the highest standard in this regard.
