Curious About the Clause That Stops You from Joining a Client After Resigning? Let's Discuss!

Hello Everyone, I would like to know the name of the clause which states that "an employee is prohibited from working for a client for the next few years." Apparently, it's pretty common in India; it's there in Flipkart as well. Please help me with this. Also, do attach some sample contracts if you can which state this clause. Thank you.

Hi, It is a non-poaching agreement to be entered with the client, which will restrict the client from hiring your employees. For employees, a non-disclosure agreement can be obtained either at the time of joining or on the date of exit, which restricts employees from sharing trade secrets or joining a competitor company for a stipulated time frame. However, the legal validity of an NDA in India is a question mark!
