Understanding the Sandwich Law: Does It Apply If an Employee Returns Mid-Monday?

Hello All, I have a query: if one of my employees takes leave on Saturday and then rejoins the office in the second half of Monday, does the Sandwich Law apply to him? (Note: Our company applies the Sandwich Law if an employee remains absent on Saturday and Monday.) Your prompt reply will be highly appreciated.

The basic premise is that for the sandwich rule to apply, the employee must be working either on the preceding or succeeding day. That is, from the end of the previous day to the beginning of the new day. Otherwise, it will affect attendance and availability, which would adversely impact the organization.

Hi, as the employee reported back during the second half of Monday, the Sandwich leave policy should not be applied in his case.

Since the employee remained on leave during the first half of Monday, Sunday will be counted as a leave day. Under normal circumstances, casual leave (CL) will not be counted for sandwiching. However, if he has taken a half-day CL, then he can benefit from sandwiching the holiday.
