Gratuity Eligibility: Does a 1-Month Notice Period Count Towards 5 Years of Service?

Can a notice period served for a month be considered for gratuity payments? For example, if someone has completed 4 years and 11 months of regular service and then serves a 1-month notice period, does this total 5 years for gratuity eligibility?

Hi, yes, you are eligible for gratuity. The total service period includes the notice period as well.

If your workweek is 5 days, then gratuity applicability will be 4 years and 190 days. If the company operates for 6 days, then it will be 4 years and 240 days as per the Gratuity Act. Therefore, you are eligible for gratuity whether you serve notice or not.
