Sir
I am working as senior lab instructor in a private university. I am suffering with a genetic nuero disease spino cerebellar ataxia. In which person got completely disabled in few years. My job duration is 4 years and 4 months and presently I can not walk without any assistance my speech is also very slurred it seems that my job will be gone soon. Am I eligible for gratuity and disabled pension. My grade pay is 9300 and gross salary is 26500 . And there is no contribution in epf because employer is not deducting any amount. Is disability pension applicable to private university or not .

You need to work for 5 years to be eligible for pension except in case of death

Since you are not under PF, EDLI does not apply. You re also outside the perview of ESIC.
Therefore none of those benefits will come to you.

There is no act that forces the employer to continue to employ you when you are unable to deo your job.
There is no separate act for disability pension, either.

If the disease is related to your job or is an occupational disease, then you are covered under Workman Compensation Act (not called Employee compensation act) in which case you are eligible for lumpsum payment. Otherwise, you are not eligible for it.
