Am I Eligible for a Higher Pension After the 2022 Judgment? Seeking Clarity

I am a member of EPFO since 1989 and contributed to EPF until October 2013. I completed 58 years by January 2016 and started receiving a pension from January 2016.

I would like to know if I am eligible for a higher pension according to the new judgment of 04.11.2022. Could you please clarify the above?

It is a little confusing as to how you could exit from EPF in 2013 and get the pension from 2016. Please clarify the position.

Eligibility for Pension Benefit
It appears you are eligible for the benefit as per the SC order. You have to exercise the option within the time limit set by the court. Most likely, the EPFO will issue operational instructions; follow that.

As it is after 1.9.2014, you are very much eligible for an increased pension. Please check if the joint option has been exercised. If not, please exercise the joint option and contact your employer and PF authority to get the form required to exercise the joint option by you and your employer. Best wishes.

As the company is closed, the employer did not pay the contribution, and EPF made an exit.
NARASIMHAN TS
If the company is closed, there will be a liquidator or authorized signatory. Contact him. As you are receiving a pension until then, there may not have been any default. So don't worry.

You are eligible if you retired post-2014. Please contact the PF office to exercise joint options for the employee and employer. EPFO is working on notification, and you have four months from 4.11.2022.
