Employee Leave Dilemma: Should We Count Days Around Holidays as Extra Leave?

If an employee applies for EL one day before and after a National Festival holiday or week off (totaling 3 days), can we consider it as 3 days of EL?

National and festival holidays need not be considered for PL/EL, but a weekly off falling in between the leave period can be considered. Thus, 3 days of EL/PL shall be applicable.

Earned Leave (EL) is calculated based on the worked days for daily wage workers or minimum wage-based employees. Falling on a weekly off cannot be considered as EL. If there is a CTC structure in place and leave and wages are being calculated, including weekly offs, public holidays, etc., you can include the weekly offs as Paid Leave (PL).

National holidays should not be considered as leave, even though they come in between. For festival holidays, it may depend on your company's HR policy manual or the letter of appointment/contract. If this is specified and signed as acceptance, you can take the leave.

Any organization must have a clear-cut policy regarding festival and national holidays, as well as their combination with other types of leave. Compliance with Legal Provisions If there is a State National and Festival Holidays Act or provisions in the Standing Orders that are applicable, they must be complied with in formulating the policy. A legal consultant can assist you in this regard.

When the organization has designated these holidays as non-working days, how can certain employees be deprived of them simply because they have combined them with additional leave days in their account?
