Contract Worker on a 30-Day Streak: How Should Wages and Overtime Be Calculated?

manas-nag
Under the minimum wages, a contract worker has worked for 30 days continuously without any weekly off. How many days should be considered for the basic wages, and how much will be the overtime (OT) payment? Please let me know what the impact in this case will be and how to address it when working on a weekly off. Should we pay double the wages for working on a weekly off or one day's wage against each weekly off?

Thank you.

As per law, it is mandatory to give a weekly off. Regarding overtime days, if there are four Sundays in a month, then OT days will be four; and if there are five Sundays, OT days will be five. The overtime rate is double the per day wages.

This is the wrong practice. You can refer to the formula: Payable Day Calculation Payable day = Present day + Paid holiday + EL. For OT: Overtime Calculation OT = Weekly worked day * Rate of wages * 2.

You may disburse wages at the normal rate for normal/prescribed working days. For working on Sundays (or the weekly off day), you have to pay wages at double the rate. If any National Holiday/Festival holiday falls in between, you have to provide overtime (OT) payment for that day, and you need to allow one compensatory day off for working on that day.

Is there any state other than Telangana covering 'contractual workers' (other than those falling under scheduled employment) under the Minimum Wages Act?
