Hi, an employee met with an accident and is now permanently disabled because of the employer. Their monthly salary is 70k. What benefits will they receive from the company?

Assuming he is not removed from the job because of this, he will receive compensation under the Employee's Compensation Act. You need to read the act and the schedule to determine what is applicable.

If he is removed from his job, then in addition to the above, he will receive gratuity (if employed for more than 5 years).

Hi, sir, thank you for your valuable information. He is still in his job. Unfortunately, he has lost vision in one eye and undergone major skull and spine surgeries with implants. His spine is expected to recover only up to 80%, and he will have a slight bend for the rest of his life. Please guide me on how much compensation we can ask for.

Regards,
Radhika

From the description, it appears the employee will not be able to lead a normal life and is incapacitated to perform the work he did before the accident, so he will be entitled to compensation for total disablement.

Compensation for Permanent Total Disablement
The compensation payable for Permanent Total Disablement resulting from the injury is a minimum of Rs. 140,000 or 60% of the monthly wages of the injured workman multiplied by the relevant factor as per the completed years of age, whichever is higher.

You need to approach the Commissioner of Labour in your area and seek his assistance. His team will help you determine the amount of compensation due and can also submit the application on your behalf to the company.

Compensation and Medical Expenses
In addition to compensation under the Employee Compensation Act, you are eligible for unlimited medical expenses until the time he recovers (to the extent possible).

Employee is 40 years old. For the past 8.6 years, he has been working with the same company. The employee is very healthy, and there were no remarks at work before the accident. Our family is suffering physically and mentally.
