How Should We Draft a Final Warning to Members About Paying Legal Fees?

kchichamo@gmail.com
Can someone please write a warning notice or letter addressed to association members? It concerns the membership fee, which is used to pay for a lawyer's services and to fight for the association's cause, as it charges per head. It's the final notice to the members. As such, members failing to pay the fee will be excluded/removed, and the association will go forward without them.

Hi,

Clause in Association Bylaws

Do you have any clause in your association bylaws stating that members will be removed without any explanation if they default on the membership fee? Is your association registered or unregistered?

Providing a warning notice is straightforward, but without understanding the background of your association, we cannot provide an appropriate warning notice.

Alternative to Warning Notices

Instead of sending a warning notice, consider calling all members for a common meeting. Explain the hardships faced by the association due to the absence of membership dues from certain members. Obtain a declaration from those defaulters stating that if they fail to make the payment on or before [date], they agree to any action initiated by the association, including expulsion. It may be challenging to secure such direct letters, but try to convince them to either make the payment or leave to ensure the smooth operation of the association.

Just write your notice telling them what you have told us. It's that simple. It's just a simple notice, not a great novel, so just stick to the basics and keep it simple. If you are uncertain, write the notice and then submit it here for comments by others.
