Worried About Missing Form 16 for Background Check? Here's What You Can Do!

Help needed! I applied to CTS and got selected. As my salary is below the tax slab, I did not receive any Form 16 from my employer for the first year. CTS is asking me for Form 16, but I don't have that. I have bank statements, salary slips, and offer/appointment/relieving letters with me.

Will they revoke my offer? Do all companies ask for Form 16 for BGC?

When your tax is not deducted, you will not receive Form 16. Please ask your current employer to provide an income certificate in Excel, duly signed by them. They cannot cancel your offer due to this. You can also provide a self-declaration of your month-wise income.

Today, I received an email from them. They mentioned that whether income is taxable or non-taxable, you should obtain Form 16. Additionally, they advised me not to deactivate my salary bank account. This is my first job switch, and it's becoming frustrating.

Income Taxable or Nontaxable
Income taxable or nontaxable does not matter for Form 16. It can be issued for nontaxable amounts for employees as well.

Prem Chandra, I asked them again and again. They are saying it's for the year 2019-2020, and the due date has passed, so they cannot issue it now. Am I overthinking this? Are bank account statements or salary slips enough?

They are right. You can't issue after the closing due date. First, correct yourself and don't ask for things that are beyond the due limitation.

If you are overthinking, request the employers; they will show you the way.

Issue of Form 16
The issuance of Form 16 is compulsory only if you have taxable income. Employers are not obligated to provide it in any other case. Some employers might give it if the employee requests, but if they refuse, there's nothing you can do. The HR of your new company seems to be unaware of this. Unfortunately, you cannot antagonize them. Explain the situation to them, and logically, they should be able to verify your salary from your bank account.

Completely agree, but some organizations like CTS insist on Form 16. How to tackle that? I am afraid about my offer if it will get revoked due to Form 16.

You need to explain that the previous company did not provide Form 16 and that there is nothing you can do about it.
