Can I Take EL while Serving A Notice Period?

Leaving the fact what Act aside, in general notice period is meant for handing over/completing your responsibilities with the existing employer depends on your role and responsibilities. Hence most companies restrict leave during notice period. However if you have any justifying reason for your leave, on sickness/emergency grounds you may avail in prior discussion with the employer. Most of the employers tend to extend the notice period matching your leave days.

Provided a smooth handing over of responsibilities and orientation for the new incumbent/substitute, availing any kind of leave should be permissible during the notice period. If the presence of the staff is required fully for the entire notice period, then there should be the option for encashing the un availed earned leave at credit.
Kindly be guided accordingly.

You can take leave in your notice period if you have a medical emergency. Else tried to avoid taking leave during notice period .
notice period is given by the employee so that the employer can search for a new employee and give a handover to the new employee.
so if you take leave then most of the companies extend your notice period and so that you can do proper handover to the new employee. .
