Facing Job Overlap Issues: How Can I Resolve Employment Date Conflicts?

lalit-giri
Hi sir, I have a new offer and have already sent an email to my current company, which they accepted. However, upon submitting the experience letter to the new company, an overlap was found between my previous and current employment. They have requested to rectify this issue.

Unfortunately, my previous company has denied the request, citing that I approached them too late and that changes cannot be made as the financial year has already shifted. They have also asked for a screenshot showing the Online portal manager accepting my resignation on 5-11-21, where my request date of 30-09-21 is also visible. Despite my last day being mentioned as 30 Sep in the same email, there has been no response from the HR or manager at the company.

I departed from the company on 30 Sep after providing a written handover. I am concerned about the potential impact of this experience overlap on my career. Can I take any action to address this issue?

Regards, Lalit

Hi, I applied to resign on September 7, 2021, and was released from the company on September 30, 2021, after completing the handover process. My direct manager accepted my resignation on September 30, 2021, and I have since joined a new company. I sent a reminder email to my previous company on October 6, 2021, due to the delay in processing my resignation. However, they did not respond and instead sent me a resignation letter dated December 23, 2021, with the release date incorrectly stated as November 5, 2021, instead of the correct date of September 30, 2021. I did not notice this discrepancy initially.

Now, as I am trying to move forward with my new company, they are flagging this as an overlap in employment. Despite my efforts, the old company has not rectified the release date issue, which is negatively impacting my opportunities at the new company. I would appreciate any guidance on how to address this situation.

Quite frankly, I don't see why your new employer is even bothered with it and how they expect you to get it corrected. By law, you have no grounds to force the employer to change their records. You can, at best, request them to help you out.
