As far as the payment of gratuity as per the Act is concerned, the question is whether the employee has worked in the same establishment or not. The employer or director being the same is not material. Subject to other eligibility criteria as per the Act, if the continuous service in an establishment is five years or more, then gratuity is payable.
Please check with your company to ensure your gratuity registration process is completed. It is in no way related to the director or the sister concern company.
