Gratuity calculation For break in service - What will be my period of service?

I joined the college on 02.05.2005 and continued until 14.02.2016. I resigned on 15.02.2016 and rejoined on 03.03.2016. However, my service was discontinued on 30.06.2016.

I am wondering about my period of service for the Gratuity claim. I have both PF and pension benefits.

Since you worked only until 14-2-2016, you would be eligible for gratuity at the time of leaving the employment. In any case, your services were discontinued in 2016. Why are you asking this question in 2022? The period of limitation is 3 years, and you cannot claim it now anyway.

The human being is very selfish and greedy. Your employer considered your case for reemployment, yet you are worried about your 4-month gratuity payment.

Please note that your maximum entitlement for gratuity was 11 years, whether you worked up to 14.02.2016 or 30.06.2016. So, relax; you are not a loser for a single penny.
