Employee Absence Dilemma: How Should We Handle a No-Show After Promised Return?

Employee Absence Issue

Our employee has been missing from service for the past two weeks. We have sent an unauthorized leave notice to his registered address, but the employee has moved to a different location. He did not inform the HR department about this change. The same letter was also sent to his WhatsApp number. He received the letter and responded with the message, "I will come to the factory next Monday," dated 24/06/2022.

However, he has not yet arrived at the factory. Could you please suggest the next step?

You need to convey a message through WhatsApp as below:

Unauthorized Absence Notification

You have been unauthorizedly absent since..........

In this regard, a notice/letter was sent to your last known residential address as declared by you and borne on our records. This letter was returned unserved as you were reported to have not been living at the address.

Furthermore, you have not updated your present address in the official records as required by the company's rules/certified standing orders.

We communicated the contents of the letter/notice to your WhatsApp number on ....... In response, you replied to us via WhatsApp, stating that you would return to the factory on 24th June 2022. However, you have not reported for work until now.

Under the circumstances, please note that unless you resume work on or before (set a deadline as you deem fit) upon receiving this communication with a satisfactory written explanation for your unauthorized absence, we shall hold a reasonable presumption that you have abandoned/left the services of your own will. Consequently, your name will be struck/removed from the company's rolls without any further reference to you, and any dues will be settled by the Accounts Department in due course.

P.S. In cases where there are certified standing orders, you need to quote the relevant clause or model standing orders clause in the absence of certified standing orders when referring to abandonment.
