Is it mandatory to provide CL & SL to the employee in a factory?
If yes, then please tell me in which section of Factory Act-1948 Casual Leave & Sick leave is mandatory to provide employees in a factory?

Under Factories Act there is no provision for granting Casual leave and Sick leave. The only applicable leave under Factories Act is annual leave with wages or Earned leave which is earned by working in the factory for certain periods in the preceding year.

What Mr. Madhu T K has been posted is absolutely right. If you have Standing Orders, there may be provision of CL or SL. There are organizations where by collective bargaining process with Union(s), CL /SL/ any other leave may be introduced.

Usually ESIC covered employees are enjoying sick leave(SL) as per ESI rules and regulations.

Hi,

There is a separate Act The Punjab Industrial Establishment (National and Festival Holidays and Casual and Sick Leave) Act, 1965 applicable in Punjab & Haryana State
specifies Casual and sick leave. – Every worker shall, in each calendar year, be allowed by the employer casual leave for seven days and six leave for fourteen days in such manner and on such conditions as may be prescribed.

Hope it would give some clarity.

Thank you Mr. Ved Prakash Jain for your post. As labor is in concurrent list of the constitution, there are State amendment of Central Act as well State Act as you have mentioned. Other States also have some other State Acts.

The sick leaves and casual leaves are incorporated by the States in Industrial Establishment (National and Festival Holidays and Casual and Sick Leave) Act, or in Shops and Commercials Establishment Act.

Thanks to all colleagues for providing clarifications to the querist. However, I fee sad that the querist seems that he has not gone through any Act and require spoon feeding information.
I think the querists should read for their own benefit before placing their query in this forum as it will be very much helpful for them.

In maharashtra there is no provision by any Acts governed by State government which provides guidelines to give CL or SL hence as per Factory Act only Priviledge leaves are mandatory
