Confused About Notice Period Clause in My Appointment Letter – Can Someone Explain?

amrita-kundu
I need to clear a clause mentioned in my appointment letter under the notice period, which is:

"Post confirmation, services may be terminated by either party, giving two months' notice, which comprises a non-negotiable mandatory working period of 1 month, with the remainder of the notice period being negotiable on both sides (to agree on the release date & salary payment in lieu of notice if any)."

I am very confused because there are two time periods mentioned in this clause—2 months and 1 month. Can anyone please clearly explain this clause to me?

When it comes to a notice period of 2 months, 1 month is compulsory. This means you must serve one month's notice by working and cannot pay to adjust it. The remaining 1 month can either be adjusted in lieu of salary or the employer can release you based on your work completion without adjusting your salary.

Therefore, you are required to work for one month without the option to request early release by paying money.
