Facing a Vigilance Case at Work: Can I Resign and Join a Private Company Without Issues?

anurag-kumar1
Hello, I am working in a government organization, and things are not going well in my office. There might be some vigilance case pending against me. Can I resign and join a private company in this situation? Or do I need a proper relieving letter for joining a company?

Also, can a company block the resignation process on grounds of a vigilance case or internal proceedings?

Resignation and Ongoing Investigations

No one can be forced to continue working for a company they do not want to work for, so no one can 'block' your resignation.

However, if there is an investigation or internal inquiry ongoing, you will need to cooperate, provide details, and appear before the officer for a hearing or clarification if required. Failure to do so may escalate the matter to involve the police, potentially leading your new employer to dismiss you from the job.

Resignation and Vigilance Cases in Government/PSU Service

If there is a vigilance case pending or contemplated, then the resignation is not accepted in Government/PSU service. These are the HR policies of the respective organization, and this is followed. So, there is every possibility that your resignation from service may be rejected.

Relieving Order Requirement in Private Firms

Whether a private firm will want a relieving order from the previous employer for joining it depends on its policy, as there are both types of organizations.
